I am facing harassment from my husband and in-laws and also wish to file for divorce. Can I pursue a domestic violence complaint alongside divorce proceedings in Agra?

Yes, you can file a domestic violence case along with divorce in Agra, and doing so is often strategically wise rather than duplicative, because the Protection of Women from Domestic Violence Act, 2005 provides a distinct set of civil reliefs, protection orders, residence orders, monetary relief and custody orders, that operate independently of and in addition to whatever relief you eventually secure in your Hindu Marriage Act divorce petition.

A complaint under Section 12 of the DV Act can be filed before the Judicial Magistrate or, in many jurisdictions including Agra, before the Family Court itself where it is already seized of the connected matrimonial matter, and interim protection orders, residence orders preventing dispossession from the shared household, and interim monetary relief under Section 20 can typically be secured within weeks, far faster than the timeline for a full divorce decree. Running a domestic violence case along with divorce in Agra also means your evidence of cruelty, harassment or physical abuse effectively does double duty, strengthening both your DV complaint and your cruelty ground under Section 13(1)(ia) of the Hindu Marriage Act.

Coordinating two parallel proceedings without contradicting yourself on facts or timelines requires careful case management, and courts do scrutinise consistency across filings, so professional drafting from the outset saves considerable trouble later. The team at Aapka Legal Advice frequently structures these dual-track strategies so that the DV complaint and the divorce petition reinforce rather than complicate each other, and where the abuse allegations are contested, a candid pre-filing review from our panel of retired High Court judges helps ensure your narrative and evidence are airtight. For representation before both forums in Agra, the Top Divorce Lawyers in Agra directory lists advocates experienced in combined matrimonial and DV litigation.

It is worth noting that a DV complaint does not require you to have already filed for divorce, and conversely you are not obligated to pursue one if you file the other, but where genuine abuse has occurred, pursuing both together typically secures faster interim protection while the slower matrimonial trial proceeds. Protection orders under the DV Act can also restrain the respondent from further contact, aggression or entry into the shared household while the divorce case is pending.

In summary, filing a domestic violence case along with divorce in Agra is legally permissible, strategically sound in genuine abuse situations, and gives you access to faster interim relief than the divorce petition alone would provide, so long as both cases are drafted consistently and pursued with proper legal guidance.
