How can I recover my streedhan after separation in Agra?

I have separated from my husband and he is refusing to return my jewellery and gifts received at the time of marriage. What legal remedy is available in Agra to recover my streedhan?

If you want to recover streedhan in Agra after separation, the law is firmly on your side, because streedhan, meaning all gifts, jewellery, cash and property given to a woman before, during or after her marriage, is recognised as her absolute and exclusive property under Hindu law, and neither her husband nor his relatives acquire any ownership right over it merely by taking custody of it during the marriage. Even if streedhan was handed over to the husband or in-laws for safekeeping, they hold it only as trustees, and refusal to return it on demand can attract both civil and criminal consequences.

On the civil side, you can seek recovery through an application under Section 27 of the Hindu Marriage Act, 1955, filed along with your divorce or maintenance proceedings before the Agra Family Court, listing every item with as much specificity as possible, ideally supported by wedding photographs, videos, receipts, valuation certificates or witness testimony from those present when the gifts were given.
