My spouse is currently the nominee on all my life insurance policies. After our divorce is granted by the Bengaluru Family Court, does the nomination automatically change or do I need to separately update it? Can my ex-spouse still claim insurance proceeds if I die before updating the nomination?

Life insurance nominations do not automatically change after divorce is granted in Bengaluru, and this is a genuinely important point that many people overlook, since a policyholder's former spouse can technically remain the recorded nominee on a life insurance policy unless the policyholder proactively takes steps to update this nomination following the divorce.

Under Indian insurance law, a nomination made under Section 39 of the Insurance Act, 1938, primarily determines who is legally entitled to receive the policy proceeds on behalf of the deceased's estate, and importantly, a mere nomination does not by itself confer absolute beneficial ownership unless it qualifies as a "beneficial nominee" under the amended provisions, typically applicable to specific categories like parents, spouse, or children in certain contexts. This distinction matters significantly in divorce situations, since even after the marriage legally ends, an outdated nomination naming the former spouse can create confusion, disputes, or unintended financial consequences if the policyholder passes away before updating their records.

If you have recently obtained a divorce decree in Bengaluru, it is strongly advisable to immediately submit a nomination change request to your insurance company, formally substituting your former spouse with your preferred nominee, whether that is a parent, child, sibling, or anyone else you choose. This process typically requires submitting a simple nomination change form along with a copy of your divorce decree, and insurance companies generally process such updates without significant complication once the divorce is legally finalised.

It's also worth reviewing any settlement terms from your divorce that may specifically address insurance policies, since some settlements explicitly require one spouse to maintain a policy naming children as beneficiaries for ongoing financial security, particularly where child maintenance or educational expenses are involved โ€” in such cases, changing the nomination should align carefully with what your settlement legally obligates you to maintain, since deviating from agreed terms could expose you to future legal complications.

Given how easily this important step gets overlooked amid the broader emotional and legal process of divorce, it is worth building it into your post-divorce checklist with your lawyer's guidance. The team at Aapka Legal Advice routinely reminds clients in Bengaluru to update insurance nominations, along with other post-divorce documentation, as part of comprehensive settlement follow-through. Its family lawyers in Bengaluru, supported by a panel of retired judges available for consultation, can help ensure nothing important slips through the cracks after your decree is granted.

In short, life insurance nominations in Bengaluru do not change automatically after divorce, making it essential to proactively update them to reflect your current wishes and any settlement obligations.
