The maintenance order was passed recently by the Pune Family Court but my application was filed two years ago. Can the court direct payment of maintenance from the date I filed the application rather than only from the date of the order?

A genuinely important financial question for maintenance claimants is whether maintenance in Pune can be directed to be paid retroactively from the date of application, and the answer is generally yes, reflecting a recognised principle designed to prevent a claimant from suffering financial hardship purely due to the time litigation naturally takes to resolve. Maintenance in Pune can indeed be directed to be paid retroactively from the date of application under Section 125 CrPC (now Section 144 BNSS), which specifically empowers courts to award maintenance from the date of the application itself, rather than only from the date the order is finally passed, recognising that proceedings can take considerable time to reach a decision.

To have maintenance in Pune directed retroactively from the date of application, it is generally not necessary to make a separate, specific request for this beyond the maintenance application itself, since courts routinely consider this retroactive effect as part of the standard maintenance determination, though clearly highlighting this request in your application, along with the specific dates involved, ensures the court's attention is properly drawn to the point. Under the Hindu Marriage Act's maintenance provisions as well, courts have discretion to award maintenance pendente lite from the date of the application, similarly recognising the practical hardship of litigation delay.

It is worth understanding that while retroactive maintenance from the date of application is a recognised and commonly granted relief, courts retain discretion in fixing the exact effective date and amount based on the specific facts, and a claimant should not assume this relief is entirely automatic without properly presenting the application and the relevant financial circumstances clearly to the court. Once such retroactive maintenance is granted, any arrears accumulated from the application date can then be pursued through the same execution and enforcement mechanisms available for any other unpaid maintenance order.

Given how much retroactive relief benefits from being clearly and properly requested in the original application, careful drafting from the outset is genuinely valuable. In summary, maintenance in Pune can indeed be directed to be paid retroactively from the date of application, and properly presenting this request within your original filing ensures the court's clear attention to this valuable, commonly granted relief.
