A prosecution sanction was granted against me by the government authority for a corruption-related offence. I believe the sanctioning authority did not independently examine the case and merely rubber-stamped the Bangalore Police request. Can I challenge the validity of the sanction for prosecution on this ground?

If you are a public servant facing prosecution in Bangalore and the required sanction for prosecution was granted, in your view, without the sanctioning authority genuinely applying their mind to the relevant material, this is a valid and often powerful ground to challenge the proceedings. Sanction for prosecution, required under Section 218 of the Bharatiya Nagarik Suraksha Sanhita (formerly Section 197 CrPC) for offences committed by public servants in discharge of their official duties, exists specifically to protect officials from frivolous or vexatious prosecution, and courts have consistently held that this sanction must reflect genuine, independent consideration of the relevant facts and evidence by the sanctioning authority, not a mechanical or rubber-stamp approval.

If you can demonstrate that the sanction in your case was granted without the sanctioning authority actually examining the material placed before them, was granted by an authority not legally competent to do so, or was based on incomplete or misleading information presented to that authority, your advocate can challenge the validity of the sanction itself, which, if successful, can result in the entire prosecution being held invalid, since a defective sanction generally cannot be cured retrospectively by the court.

Courts examine this challenge by looking at the sanction order itself and any accompanying material to assess whether it reflects genuine application of mind, such as whether the order references the specific facts and evidence considered, or whether it appears to be a generic approval lacking any real engagement with the specifics of your case, since the latter suggests a lack of the careful consideration the law requires before authorising prosecution of a public servant.

Because challenging a sanction requires careful examination of the sanctioning process and the material that was, or should have been, placed before the authority, this needs detailed case-specific analysis. Aapka Legal Advice can help assess whether the sanction in your case can be successfully challenged.

If you believe the sanction for your prosecution in Bangalore was granted without proper application of mind, this deserves serious legal scrutiny. Speak with experienced criminal lawyers in Bangalore about challenging it effectively.
