The Bangalore Police seized my vehicle and equipment during investigation and they have been lying in the police malkhana for over two years. The trial is ongoing. Can I apply for interim release or return of seized property before the criminal trial is concluded?

If police have seized your property in Bangalore during an ongoing investigation and you need it back before the trial concludes, this is often possible, since the law recognises that property shouldn't remain locked up indefinitely simply because a case is pending. Under Section 497 of the Bharatiya Nagarik Suraksha Sanhita (formerly Section 451 CrPC), a criminal court has the power to order the interim custody or disposal of seized property during the pendency of trial, and this specifically allows for property to be released back to its rightful owner, particularly where retaining it in police or court custody isn't essential for the case to proceed effectively.

This provision is commonly used for items like vehicles, machinery, or business assets that would otherwise deteriorate in value or usefulness while sitting unused for the potentially lengthy duration of a trial, and courts in Bangalore generally allow release on a supurdnama, an undertaking that the property will be produced again if needed for identification or evidentiary purposes, balancing the practical hardship of prolonged seizure against the prosecution's legitimate need for the evidence.

To secure release, your advocate would file a specific application demonstrating your ownership or entitlement to the property, along with an explanation of why continued seizure causes hardship and why the property's evidentiary value wouldn't be compromised by its release, and the court typically seeks the investigating officer's input before passing an order, since certain items may need to be retained for further forensic examination or as evidence at trial.

Because the specific documentation and arguments needed to secure release vary depending on the nature of your property and how central it is to the case, having your application properly prepared makes a meaningful difference to your chances of success. Aapka Legal Advice can help you put together a strong application for interim release of your seized property.

If your property has been seized in an ongoing Bangalore investigation and you need it back before trial concludes, this is often achievable. Consult experienced criminal lawyers in Bangalore about filing the right application.
