The Kolkata Sessions Court has passed an order against me in my criminal matter. My lawyer is unsure whether to file a criminal revision petition or a criminal appeal. Can both a revision petition and an appeal be filed simultaneously against the same criminal court order?

Generally, no โ€” a criminal revision and an appeal cannot typically be filed simultaneously for the same order in Kolkata, since Indian criminal procedure generally treats these as alternative rather than concurrent remedies, meaning if a specific right of appeal is available against an order, the revisional jurisdiction of the Calcutta High Court is generally not simultaneously invoked for the same matter, reflecting the principle that revision is typically reserved for situations where no adequate appellate remedy exists.

This general principle exists because revision and appeal serve overlapping but distinct purposes within the criminal justice system, with appeal typically providing a more comprehensive review of both facts and law, while revision is generally intended as a supervisory mechanism to correct manifest errors or jurisdictional excesses where the ordinary appellate process is unavailable or inadequate, meaning pursuing both simultaneously for the identical order would create unnecessary duplication and potential inconsistency in judicial proceedings.

However, this does not mean revision and appeal are entirely mutually exclusive in all circumstances โ€” a party might have a right of appeal against certain aspects of a judgment while separately seeking revision for entirely distinct issues not covered by the appellate remedy, or in specific procedural contexts, the two remedies might address genuinely different orders passed at different stages of the same broader proceeding, meaning the specific facts and procedural posture of your case significantly determine what combination of remedies is appropriate.

Given the technical distinction between these remedies and the importance of pursuing the correct pathway for your specific circumstances, it is essential to consult experienced criminal law counsel who can properly assess which remedy, or combination of remedies, is appropriate for your situation. Consulting the team at Aapka Legal Advice can help you determine whether appeal, revision, or some combination of these remedies is the correct approach for your Kolkata criminal matter.

Given the strategic importance of correctly identifying the appropriate remedy to avoid wasted effort or procedural complications, obtaining a second opinion from a retired judge on the best approach for your specific case can provide valuable clarity. Kolkata's experienced criminal lawyers and retired judges, available through Aapka Legal Advice's Kolkata lawyer directory, regularly assist clients navigating these appellate and revisional matters.

In conclusion, a criminal revision and appeal generally cannot be simultaneously pursued for the identical order in Kolkata, making it essential to correctly identify which remedy applies to your specific circumstances before proceeding.
