The FIR against me has been registered at a Kolkata Police station far from where the alleged incident occurred. I believe jurisdiction is incorrect. Can I seek transfer of investigation of an FIR to the police station that actually has territorial jurisdiction over the offence?

Yes, an FIR can be transferred from one Kolkata police station to another, since Indian criminal procedure recognises that proper jurisdiction and effective investigation sometimes require reallocating a case to a different police station, particularly where the initial registration occurred at a station lacking proper territorial jurisdiction over the alleged offence, or where administrative or investigative considerations warrant reassignment to ensure a fair and effective investigation process.

If an FIR was initially registered at a Kolkata police station that does not have proper territorial jurisdiction over where the alleged offence actually occurred, the standard procedure involves transferring the FIR to the police station with appropriate jurisdiction, ensuring the investigation proceeds under the authority of the correctly empowered local police unit rather than continuing under a station that lacks the proper territorial connection to the case.

Beyond jurisdictional transfers, an FIR transfer can also be sought in circumstances involving genuine concerns about the fairness or effectiveness of investigation at the originally registered station, such as where there are credible allegations of bias, conflict of interest, or inadequate investigative capacity, and such transfers are typically sought through appropriate application to senior police officials or, where necessary, through court intervention if administrative channels prove unresponsive to legitimate concerns.

Given the various circumstances and procedures potentially applicable to seeking an FIR transfer, it is important to work with experienced criminal law counsel who can properly assess your specific situation and pursue the most effective approach, whether through administrative channels or court intervention. Consulting the team at Aapka Legal Advice can help you navigate the FIR transfer process for your Kolkata criminal matter.

Given the potential complexity involved in successfully securing an FIR transfer, particularly where administrative channels prove unresponsive, obtaining a second opinion from a retired judge on the best strategy for your specific circumstances can provide valuable guidance. Kolkata's experienced criminal lawyers and retired judges, available through Aapka Legal Advice's Kolkata lawyer directory, regularly assist clients with these jurisdictional and transfer matters.

In conclusion, an FIR can indeed be transferred from one Kolkata police station to another where jurisdictional or fairness concerns genuinely warrant this reallocation, making it important to pursue the appropriate administrative or judicial channel based on your specific circumstances.
